The research focus is the study by a Delphi panel comprised of prosecutors, defense attorneys, judges, and crime scene investigators of a staged crime scene documented by desktop computer panoramic virtual reality (VR). The use of VR to document a crime scene and as evidence at trial may be evolutionary. Distributed cognition provides a theoretical basis for understanding the adversarial criminal justice system which functions through interrelated actors who serve different roles. A criminal case begins with investigation, crime scene investigation, and often ends by trial. These relationships create a system of distributed cognition that benefits from a well-documented crime scene that is examined by and distributed through various actors including prosecutors, investigators, defense attorneys, experts, judges, and triers of fact. Distributed cognition implies this is a collective activity. The criminal justice system seeks the resolution of controversy through an adversarial process with a judge as mediator and the parties presenting evidence and argument in a controlled process. Admissible evidence is the foundation of the process. A well-done investigation, including the recovery and documentation of evidence, creates a better opportunity for actors to evaluate the strength of a criminal case. Pictures, film, video, and digital evidence revolutionized criminal investigation and evidence presentation at trial. VR documentation may further revolutionize the process by creating a more holistic visual image that allows a viewer the opportunity to move through a crime scene in a manner that satisfies the viewer's needs. The historical acceptance of filmic evidence, video evidence, and digital evidence suggests VR will be accepted in court on a foundation that it is a true and accurate depiction of the crime scene. The Delphi panel over two rounds indicated visual documentation in the form of diagrams, pictures, and video is very important to criminal justice actors, including triers of fact. Additionally, the panel indicated VR provides a new and enhanced method to document a crime scene and that VR should be admissible as evidence like pictures, film, and video on a showing the VR is a true and accurate depiction of the crime scene.
