Ethics committees were established to create bodies for making difficult decisions in medicine that are fraught with ethical implications. These committees have not been without their challenges, however, particularly when dealing with cases that must navigate clear clashes of values. This paper will argue ethics committees have failed to live up to their charge of resolving these clashes as they have been hampered by the modern context of political liberalism. Through its treatment of the individual and individuality, this paper will suggest that political liberalism and its inability to reconcile differences about the good life has hampered the ethics committee and thus has impeded resolution of conflicts about medical futility. In addressing conflicts of values, I argue liberalism offers only the imposition of one set of values upon another and in so doing acts against its own core conceptions. Under these conditions ethics committees are not able to engage in deep ethical inquiry and adequately act to address the underlying differences, a limitation best seen as they struggle with medical futility. Ultimately, I will argue ethics committees would operate best and would better address conflicts of values, such as with medical futility, under a communitarian construct: uncovering and establishing values in a considered and intentional manner in local medical moral communities.
This paper begins by looking at previous approaches to futility and how some problems of liberalism have affected the discussion of medical futility as well as some of the legislative attempts to address futility and how liberalism has complicated these efforts. Next, I offer an interpretive review of the history of ethics committees, highlighting how liberalism has impeded their development and their ability to address conflicts, particularly around medical futility before presenting a communitarian approach that offers to address the shortcomings of the liberal approach. Finally, I propose a reinvention of the ethics committee, attempting to revive a promising but underutilized forum.
